Welcome to the Movtify Agent & Partner Program (the "Program"). By registering as an Agent, or sharing your assigned discount code/referral link, you (interchangeably referred to as "Agent", "Partner", or "You") agree to be bound by these Terms & Conditions and enter into a legally binding agreement with Movtify.com ("Movtify", "We", or "Us").

1. Overview & Agent Status

Independent Agent Status: You participate in this Program strictly as an independent agent under an independent contractual relationship. Nothing in these Terms shall be construed to create an employment, partnership, joint venture, or legal agency relationship between You and Movtify. You have no authority to bind Movtify legally or make commitments on Movtify's behalf.

Program Purpose: You may refer family, friends, and online audiences to purchase products on Movtify.com using your unique referral link or discount code to earn eligible commissions.

2. Qualified Orders & Commission Calculation

Earning Structure: Commissions are earned when a customer successfully uses your Agent Discount Code at checkout or completes a purchase via your referral link, and the order is verified, completed, and non-refunded.

Commission Rates:

• First Rate (Initial Purchase): Applied to the first valid order completed by a customer you successfully referred.
• Base Rate (Repeat Purchases): Applied to subsequent orders placed by your referred customers, calculated according to Movtify's active payout tiers and customer spending activity.

Exclusions: Cancelled orders, refunded items, fraudulent transactions, and shipping/tax charges are not eligible for commission. Self-referrals (purchasing through your own referral link for personal use) are strictly prohibited unless prior written permission is granted by Movtify.

3. Payout Schedule & Account Management

Payout Terms: Commissions are calculated on a calendar-month basis to accommodate standard order holding and return periods. Payouts are processed between the 2nd and 5th business days of each month for all verified commissions from the previous cycle. Payment methods include bank transfer, FPS, or Movtify Store Credit. A minimum payout threshold of HKD 500 applies to each withdrawal.

Data Accuracy: You are responsible for ensuring that your contact details and payout account information registered in the Agent Dashboard are kept up to date and accurate at all times.

4. Discount Code Usage & Brand Guidelines

Prohibited Channels: You may not publish your Agent Discount Code or referral link on unauthorised coupon aggregator sites, discount databases, or public forum sections specifically targeting general discount-seeking behaviour.

Search Engine Bidding Restrictions: You may not bid on search engine keywords containing "Movtify" or its variations (e.g. running Google Ads PPC campaigns targeting brand search terms).

Intellectual Property: We grant You a limited, non-exclusive, revocable right to use Movtify's logo, product images, and promotional materials solely for the purpose of promoting Movtify.com.

5. Termination & Limitation of Liability

Termination: Either party may terminate participation in this Program at any time via written notice. Movtify reserves the right to immediately terminate an account and void any outstanding commissions upon discovery of fraud, trademark infringement, or policy violations.

Limitation of Liability: The Movtify platform and services are provided on an "as-is" basis. Our maximum cumulative liability under this Agreement shall not exceed the total commissions actually paid to You in the 12 months preceding the dispute.

6. Governing Law & Jurisdiction

This Agreement is governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR) of the People's Republic of China. Any legal disputes arising from or in connection with this Program shall be subject to the exclusive jurisdiction of the courts of the HKSAR.

7. Mandatory Identity Verification (KYC) & Personal Data Privacy

In compliance with Hong Kong anti-money laundering regulations, applicable statutory requirements, and the Personal Data (Privacy) Ordinance (PDPO), Movtify requires all agents to complete mandatory identity verification (KYC) prior to receiving their first commission payout. You agree to submit a valid government-issued identity document (e.g., Hong Kong Identity Card or passport) and provide valid payout account details. All submitted personal data is encrypted and used solely for identity verification, fraud prevention, payout processing, and legal compliance purposes in accordance with our Privacy Policy. Movtify reserves the right to request additional account verification documentation whenever necessary or in cases of suspicious account activity.

8. Store Credit Coupon Redemption Rules

If You choose to redeem your commission balance as a Movtify Store Credit Coupon, the coupon will be issued in the form of a one-time use promo code valid for 3 years from the date of issuance. Any remaining unused balance or amount after checkout will not carry over to future purchases and will automatically forfeit upon redemption. Once generated, the Store Credit Coupon redemption is final and cannot be refunded, exchanged, or converted back to cash.

9. Traffic Review & Anti-Fraud Attribution

Movtify reserves the right to review all referral traffic and sales attribution sources. Commissions generated through automated bots, public coupon platforms, or unauthorised promotional methods lacking verifiable click sources may be subject to manual review, adjustment, or withheld at our discretion.

10. Terms Amendments & Updates

Movtify reserves the right to modify, update, or replace any part of these Terms & Conditions at any time at its sole discretion. Material changes will be communicated via email notification or direct announcement in the Agent Dashboard. Your continued participation in the Program following the posting of any updates constitutes your acceptance of the revised terms.
